International Service of Process is performed under the
legal frame proposed by the
"Hague Convention". This international treaty proposes different
channels of serving Judicial and Extra judicial documents for Civil and Commercial
matters. These methods can be classified as "Centralized" and
"Decentralized". All methods are equally valid and
important and there is no hierarchy between them, the difference is basically in that one is
a "Public Service" and the other is "Private". The
fact that one is a "Public Service" does not mean that is
cheaper and is not excepted of "vices" or "Problems"
We specialized in the "decentralized"
or "Private service of process" performed within
10 days (If required within 72 hrs) of reception of material. We also assist
with the "Centralized" or "Public
Service", but without any timeframe. Nevertheless, when using this
channel we can remove any obstacle or vice in the concerned jurisdiction to accelerate
this
Public Procedure.
The International Laws that govern the "Service of
Process" are sometimes confusing and the Hague Convention has articles
that can enter into "International conflict of Law" with some
jurisdictions, some
precepts are inapplicable under certain European Constitutions reason why
we advise the use of a Law office and not of any "Process
Servers".
The "Public Channel" of Service of Process is not perfect an
runs into obstacles when enters in coalition with the
Roman-Napoleonic Civil law system traditions where each country has their
own Code of Civil Procedure and special set of law.
As a Law office we can only advise you in
relation to the Hague Convention and its application in European Roman-Napoleonic
law and which channel to use,
please contact your Attorney for information regarding your country's
law.
